Sea Bags Messages Mobile Terms & Conditions

The Sea Bags mobile message service (the "Service") is operated by Sea Bags, LLC ("Sea Bags", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Sea Bags's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Sea Bags through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include specials, promotions, and other marketing offers (e.g., cart reminders).
By signing up, you are confirming you are over the age of 13.
Optional. You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Sea Bags. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to 85171 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Sea Bags mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Auction Terms & Conditions
These terms and conditions apply to all online bidding for Auctions conducted by Sea Bags. By registering to participate in a Sea Bags' Auction, you expressly agree to these terms and conditions.
- All participants ("Bidders") must create an account at seabags.com. All registration information that the Bidder provides to Sea Bags shall be current, complete, and accurate. Bidders must be 18 years of age or older and a legal resident of the United States.
- Bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during the auction sale.
- Once a bid has been placed, that bid will be considered final—placing a bid is a binding contract and the bid cannot be retracted. Once you place a bid, you are agreeing to purchase the product at the price indicated in your bid.
- The Winner of an Auction will be notified via email and provided with a link to process payment. All sales are subject to appropriate state Sales Tax laws. Winner will also receive an electronic receipt upon conclusion of the sale.
- Sea Bags cannot be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Sea Bags, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction.
- Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless Sea Bags and its employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses (including reasonable attorneys' fees and expenses) related to, arising from or associated with Buyer's, his agents or representatives, use of the Site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item/lots, and arising out of, based upon, or resulting from any breach or violation by Bidder of this Site User Agreement or any use by Bidder of the Site or as a result of a dispute with another Bidder.
Custom Visualizer Terms & Conditions
The preview generated by this visualizer tool is an approximation of how the finished product will look. Our designers may make small adjustments to the size and placement of artwork in order to ensure production quality standards are met. Sea Bags owns the final artwork for any design created or modified using this tool. All artwork we own may be used for both marketing and product development.
Artwork colors on the finished bag will vary slightly from the on-screen preview as well as from bag to bag. Each recycled sail panel is unique and features some assortment of original stitches, hardware, and other reminders of that sail's previous life on the ocean.

Anchor Rewards Terms & Conditions
Effective April 27, 2020
By registering to become a member of The Anchor Rewards program and by participating in the Program, you (i) represent that you are 18 years of age or older, and (ii) agree to the following Program Terms and Conditions (these "Terms"). Anchor Rewards is sponsored by Sea Bags.
1. Anchor Rewards Overview
When you join Anchor Rewards, it allows you to earn Points on your purchases on Sea Bags website at seabags.com and made in retail stores owned by Sea Bags. You may also earn Points by participating in special activities announced by Sea Bags from time to time. Points will be earned during the course of the year and will expire after 16 months of inactivity [see Section 3 below].
2. Membership
A. Eligibility: You must be at least 18 years of age to become a member. Employees of Sea Bags, investors and wholesale or national accounts do not qualify for membership.
B. How to Join: You may register to become an Anchor Rewards Member two different ways:
i. Online at seabags.com by creating an account and indicating that you want to be an Anchor Rewards Member or by accepting an invitation sent by email.
ii. At any of Sea Bags Stores, by providing your name and email address to sign up to be a Member. Once you make this request, you will receive an email welcoming you to the program.
C. Accessing Point Information and other Member Benefits: In order to be able to access how many Points you have earned, you must have an account at seabags.com. This will give you access to the Anchor Rewards Dashboard. To create an account, go to seabags.com and click on "My Account" at the top of the home page and provide the information to create an account. When setting up the account at seabags.com, you are responsible for creating a password to protect your account and for ensuring that you do not share your password with others.
D. Updating information: You are responsible for providing the correct email address to ensure accurate recording of Points and to receive your Rewards. As a result, each Member is responsible for maintaining accurate and updated personal information, including your email address and phone number. You may update your personal information online in Your Account or by calling Customer Service: 1-888-210-4244.
3. Earning Points
A. Points can be earned during the lifetime of your account as further described below. Members must remain active by way of earning points, redeeming rewards, or taking part in other exclusive promotions within 16 months in order for points to remain active. Expiration of points will follow a rolling expiration of 16 months and is dynamic based on customer's activity. Customers who are considered inactive for the course of 16 months will result in the expiration of all existing points.
B. When you shop at Sea Bags stores or seabags.com you will automatically receive ten (10) Points for every $1 (USD) spent on any eligible product that is purchased.
The Points earned from Qualifying Purchases will be added into your Anchor Rewards account when you provide your email address or phone number associated with your account, at the time of purchase. It can take 1-5 days for your Points to appear in your account.
If you did not provide your email address at the time of purchase, or do not see Points from a previous purchase in your account after seven (7) days, you may call Customer Service at 1-888-210-4244 and upon verification by Customer Service of your purchase or activity and that you did not previously receive Points for the purchase or activity, the Points will be added into your Program account.

C. Qualifying Purchases include regular and sale priced merchandise in Sea Bags Stores and online at seabags.com. No Points are earned when purchasing Gift Cards or eGift Cards from Sea Bags, but you do earn Points when redeeming a Gift Card or an eGift Card at Sea Bags stores or online at seabags.com. In addition, no Points are earned for payment of sales tax or for shipping and handling costs. Currently, no points are earned for purchase of Sea Bags branded items at partner brands, wholesale dealers or third party owned stores.
D. Points may also be earned for participation in certain activities designated and promoted by Sea Bags. Members may also be eligible to earn bonus Points (i.e. double points) for making purchases during a designated time as determined by Sea Bags. Sea Bags reserves the right to make bonus Points and other promotional offers available to select members based on purchase activity, tier level, geographic location, program participation, and/or information supplied by the member. Sea Bags reserves the right to add, withdraw, amend, or otherwise change bonus opportunities at any time at its sole discretion, with or without notice to members.
E. When returning an item, the Points you have earned (including bonus Points, if applicable) for that purchase will be netted from your overall Points total. Points have no cash value. You cannot give or transfer your Points to anyone else.
4. Member Benefits
A. "Rewards" means coupons issued for discounts off purchases from Sea Bags stores and online at seabags.com. Rewards are promotional items for Members of the Anchor Rewards program and are not Gift Cards or eGift Cards of Sea Bags.
B. Rewards are sent electronically to the email address associated with your Anchor Rewards account. Once issued, members can also access their Reward by logging into their member dashboard on seabags.com.
C. Membership rewards that denote a limited number of uses per year (i.e. Free shipping pass 1X per year) are relevant to the date you became a member. For example: if you become a member on June 1, 2020, you will have from June 1, 2020 - May 31, 2021 to redeem your reward. Each year, these rewards will reset at the start of your membership year.
D. Each Reward will have a unique coupon code that may be used at Sea Bags stores or online at seabags.com. In retail store locations, Rewards may be redeemed at the same time as a Sea Bags promotion. At seabags.com, Rewards are able to be combined with online promotions that are not coupon-based. Only one coupon code is able to be provided at checkout. If the promotion requires a coupon code, you will need to choose whether you would like to use the Anchor Reward or the promotion. Sea Bags reserves the right to accept, decline or limit the use of ANY coupon(s). Store Management, at its discretion, has the right to limit the quantity of coupons used for an item in a single transaction, by a single customer, or in a single day.
E. Your coupon code can be used by anyone, and you are solely responsible for protecting it from unauthorized use. If the unique Reward that is sent to you is used in a manner that was not authorized by you, Sea Bags will not replace Rewards.
However, if you delete or lose the email in which you received your Reward, contact Customer Service at 1-888-210-4244 and upon verification by Customer Service of your membership, an email with the same unique code and pin Reward will be resent to you.
F. Sea Bags, in its sole discretion, may offer additional opportunities for Members to use Points during the year.
G. Anchor Awards members may also have first access to new products, special offers and gifts, and be invited to participate in exclusive experiences for members.
5. Email and Privacy
A. By registering for the Program, you agree to receive transactional emails regarding the Anchor Rewards Program from Sea Bags. These may include information about Program Points and Rewards, Program updates, and other related materials. Members may not unsubscribe from transactional emails of the Program but can cancel their membership. When registering for the Program, Members will have the option of signing up to receive promotional email offers and updates from Sea Bags. Members may unsubscribe from promotional emails at any time via the unsubscribe link in those emails.
B. By registering for the Program, you consent to the collection, use and disclosure of your personal information as described in the Sea Bags Privacy Policy.

6. General Terms of the Anchor Rewards Program
A. Membership in the Anchor Rewards Program and its benefits are offered at the discretion of Sea Bags, which reserves the right to terminate, limit, modify, or cancel any Program rules, regulations, benefits, or conditions of participation at any time, with or without notice. In the event of cancellation, Points earned up to the date of cancellation will be issued according to the Terms in place immediately prior to cancellation.
B. Sea Bags may change or modify these Terms at any time. We will post the revision date with the revised Terms on our website. Electing to remain a Member after a change in the Terms constitutes your acceptance of the revised Terms. The revisions to the Program that Sea Bags may make include, but are not limited to, any of the following changes: (i) increase or decrease the number of Points earned on a purchase; (ii) alter the number of Points required to earn a Reward or benefit, (iii) alter the rewards given per membership tier; (iv) cease providing member benefits; (v) change the method of joining the program; (vi) institute blackout dates for earning Points or using member Rewards.
C. Abuse of the Program, including failure to abide by these Terms, the sale or trade (or the attempted sale or trade) of Rewards, Points, or promotional offers, and other improper conduct as determined by Sea Bags may result in cancellation of a Member's account and future disqualification from Program participation, forfeiture of all Points accrued, and cancellation of previously issued but unused Rewards. At our discretion, we may prosecute abuse of the Program to the fullest extent of the law.
D. If in sole discretion, Sea Bags suspects fraud, misrepresentation, abuse or violation of the applicable rules involving the Program, Sea Bags has the right to take the appropriate administrative and/or legal action, including the cancellation of accumulated points and termination of Program participation.
E. You may cancel your Anchor Rewards membership at any time by calling Customer Services at 1-888-210-4244. If you cancel your Anchor Rewards account, your accrued Points will be forfeited.
F. Points are not transferable and may not be combined among Members. Accrued Points do not constitute property of the Member. Accrued Points are not transferable by the Member upon death, as part of a domestic relations matter, or otherwise.
G. The Sea Bags logo, Anchor Rewards logo, and other logos and taglines are the intellectual property of Sea Bags.

This Program and these Terms will be governed by and construed under the substantive laws of the State of Maine, without reference to conflict-of-laws considerations. Sea Bags and member each agree that any dispute, claim, or controversy arising from or relating to this Program and these Terms or member's Program membership will be resolved by binding arbitration conducted in the State of Maine. Sea Bags and member each acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim, or controversy. Sea Bags and member each understand that a judgment on any arbitral award may be entered in any court having jurisdiction. No arbitration under this Program and these Terms will be consolidated with any other arbitration.
